Hi all, could any one help me with a problem I have. My friend and I have seen a sub trunk illusion that we like and although we are not sure how its done we have figured out how WE would do it. If we go ahead and make this ourselves and it turns out we guessed right on how it was done, would we be breaking any copyright rules if performed either as a paid performance or maybe charity act? many thanks. As far as I know the sub trunk itself is not a copyrighted or patented item, you do not usually patent a magic trick as it would mean giving away the secret. As for copyright, unless you nick someone else's patter you are in the clear. If you copy someone else's illusion, even if you have your own method you are in a slightly more difficult area both legally and ethically but the sub trunk is definitely in the public domain an dhad been worked by so many acts over a long period of time so no one can claim that it is their own. If I ever found someone using one of my own effects that had not been released into the profession and they were also using my original patter(I have always written all my own material) I would take legal action. Notwithststanding that, there is an awful lot of stuff out their and you should have no trouble in putting together your own unique act. Good luck/
Thank you for that David, I know where I stand now. I would not like to upset any one by copying their effect, I couldn't sleep. Well thats my project for the spring then.

Yes Allan, I'm sure it's fine.

If it was other illusions like the A-Frame or such, but as the Sub Trunk is such an old illusion.. performed by millions i'm sure it's not a problem.

Basically some of the larger/newer illusions are copyrighted.. the ones that cost 1000's of pounds etc.

How are you finding this site so far... Is there anything you would like to see?

You have been given some very good advice. There are lots of people out there that start stealing other peoples effects. From what you say you have not done anything morally or ethically wrong. Copyright and intelectual property laws cans be a mine field.

 

When someone does copy someone elses routine it amazes me. The effort they put inti working out how it was done, learning the patter and practicing to get it right. All that to be like someone else. How many Cris Angels or David Blaines do we need or want. Personally one of each is enough and I want to be me, Nic Castle the performer. It is making an effect, routine or performance unique that is rewarding for the individual and the audience.

 

I am sure you will enjoy making the Sub Trunk your routine. It would be great to see you post your routine on here to be seen.
